These Terms of Use ("Terms") govern your access to and use of the AI Pandit platform ("Service") operated by AIPANDIT TECH PRIVATE LIMITED ("Company", "we", "us", or "our"). By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable laws and regulations.

1. Eligibility

By using the Service, you represent that you are at least 18 years old or have obtained the appropriate consent from a parent or legal guardian to enter into this Agreement.

2. Nature of Services

AI Pandit is a custom GPT application hosted on the OpenAI GPT Marketplace and operates on OpenAI’s ChatGPT infrastructure. By accessing or using the Service, you agree to be bound not only by these Terms, but also by OpenAI’s usage policies and any applicable terms that govern its infrastructure.

The Service offers personalized astrology-based outputs including horoscope charts, predictions, remedies, and AI-generated consultative responses. These services are provided strictly for informational and spiritual enrichment purposes and do not constitute professional legal, financial, or medical advice.

Your subscription to AI Pandit is a service provided by AIPANDIT TECH PRIVATE LIMITED and does not extend, override, or modify any usage limitations or quota restrictions imposed by OpenAI on your ChatGPT subscription plan. Any service disruptions due to OpenAI plan constraints shall be governed solely by the user’s agreement with OpenAI, and the Company disclaims all responsibility in such events.

3. User Account

• To access premium features, users must register an account with accurate and current information.
• Users are solely responsible for safeguarding their login credentials and for all activities conducted under their account.
• Users agree not to use the Service for any unlawful, defamatory, abusive, or harmful purposes.

4. Subscription & Billing

• A complimentary free trial of up to 2 weeks is provided.
• Monthly subscriptions are billed monthly and are non-cancellable and non-refundable once billed.
• Yearly subscriptions are billed yearly and are refundable on a prorated basis as detailed in our Refund Policy.
• If a yearly subscription is canceled within 6 months, usage will be calculated as monthly billed plan; after 6 months, as yearly billed plan

5. Intellectual Property

All intellectual property, including but not limited to content, branding, underlying algorithms, code, and AI-generated output, are the sole property of AIPANDIT TECH PRIVATE LIMITED. Unauthorized use, reproduction, or distribution is strictly prohibited and may lead to legal action.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for:

• Decisions or actions taken by users based on Service content.
• Loss of data, access issues, or errors caused by system failures or third-party service providers.
• Any indirect, incidental, punitive, or consequential damages, including but not limited to emotional, financial, or reputational loss.

7. Service Modifications

The Company reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. Features available during a free trial may vary from those in paid versions.

8. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. All disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.

9. Termination

We reserve the right to terminate or suspend access to the Service immediately and without notice for conduct that we believe violates these Terms or is otherwise harmful to the interests of the Company or other users.

10. Amendments

We reserve the right to amend these Terms at any time. Continued use of the Service following any such changes constitutes acceptance of the new Terms.
